Terms and Conditions

These terms and conditions ("Terms", "Agreement") are an agreement between Literal Word ("we", "us", or "our") and you ("User", "you", or "your"). This Agreement sets forth the general terms and conditions of your use of the Literal Word website at literalword.com (including its subdomains), the Literal Word application, and any related products or services (collectively, the "Service").
Accounts and Membership
The Service is usable without an account. If you create one, you are responsible for maintaining the security of your account and for all activities that occur under it. We may, but have no obligation to, monitor and review new accounts before you may sign in. Providing false contact information may result in termination of your account. You must promptly notify us of any unauthorized use of your account or other breaches of security. We will not be liable for any acts or omissions by you, including any damages incurred as a result of those acts or omissions.
Your Content
The bookmarks, highlights, and notes you create in the Service remain yours. You retain all rights you may have in your content.
To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, back up, transmit, and display your content solely to provide the Service to you and to the devices you sign in on. We do not use your content for any other purpose. We do not sell your content, and we do not use it to train machine-learning models.
You are solely responsible for your content. You represent that your content does not violate any law or infringe any third-party rights.
Bible Text Licenses
The Bible translations made available through the Service are protected by copyright and are used under license from their respective rights holders. The in-passage copyright footer shows the full attribution for the version you are reading. In summary:

Your right to access the Bible text through the Service is subject to those licenses, in addition to these Terms. You may not redistribute, republish, scrape, or otherwise mass-extract the Bible text from the Service. Personal study, copy-pasting passages, and short quotations remain permitted within the limits set by each rights holder.
Links to Other Websites
The Service may link to other websites. We are not, directly or indirectly, implying any approval, sponsorship, endorsement, or affiliation with any linked website unless specifically stated. We are not responsible for the content, policies, or practices of any third-party site, and your use of any linked site is at your own risk.
Prohibited Uses
In addition to the other terms in this Agreement, you are prohibited from using the Service or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, state, provincial, or local laws or regulations; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass or harm others, including on the basis of any characteristic protected by applicable law; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or unlawful purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
Termination
You may close your account at any time from within the Service (see the Privacy Policy for the in-app path) or by contacting us at contact@literalword.com. On closure, your bookmarks, highlights, and notes are deleted per the schedule described in our Privacy Policy.
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated this Agreement or applicable law, or if continuing to provide the Service to you would create a legal or security risk.
The following sections survive termination: "Your Content" (with respect to license grants made during the term), "Bible Text Licenses," "Limitation of Liability," "Indemnification," "Governing Law," "Dispute Resolution," and "Severability."
Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Literal Word, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for: any indirect, incidental, special, punitive, cover, or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, or loss of business opportunity), however caused and under any theory of liability, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our aggregate liability and that of our affiliates, officers, employees, agents, suppliers, and licensors relating to the Service will be limited to the greater of one dollar (US$1.00) or any amounts actually paid in cash by you to Literal Word in the one-month period preceding the first event giving rise to the liability.
Nothing in this section limits any liability that cannot be excluded or limited under applicable consumer-protection law. For European Economic Area, United Kingdom, and Swiss consumers, the limitations above do not apply to any liability that may not be excluded under your local mandatory consumer-protection law.
Indemnification
You agree to indemnify and hold Literal Word and its affiliates, directors, officers, employees, and agents harmless from any liabilities, losses, damages, or costs — including reasonable attorneys' fees — arising from any third-party claim or demand asserted against any of them relating to your content, your use of the Service, or any willful misconduct on your part.
Governing Law
This Agreement is governed by the laws of the State of California, United States, without regard to its conflict-of-laws provisions. If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, this clause does not deprive you of the protection of the mandatory consumer laws of the country where you are habitually resident.
Dispute Resolution
Most concerns can be resolved by contacting us at contact@literalword.com; we ask that you do so before filing any formal claim.
Any dispute arising out of or relating to this Agreement that we cannot resolve informally will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you and Literal Word consent to personal jurisdiction in those courts. You and Literal Word each waive any right to a jury trial. This Section does not apply to the extent prohibited by your local mandatory consumer-protection law.
Severability
All rights and restrictions in this Agreement may be exercised and are applicable and binding only to the extent that they do not violate any applicable laws, and are intended to be limited to the extent necessary so that they do not render this Agreement illegal, invalid, or unenforceable. If any provision is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
Changes and Amendments
We may modify this Agreement or its policies relating to the Service at any time. When we do, we will revise the effective date at the top of this page and, for material changes, post a prominent notice in the Service. Continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms.
Acceptance of These Terms
By using the Service you acknowledge that you have read this Agreement and agree to all its terms and conditions. If you do not agree to them, you are not authorized to use the Service.
